Trail Appliances E-newsletter Subscriber Contest Promotion Rules
The Trail Appliances E-newsletter Subscriber Contest (the “Contest”) is a 14-day contest offered by Trail Appliances (“Trail Appliances”). The Contest will run from 9:00am PST on November 4, 2020 to 6:00pm PST on November 18, 2020 (the “Contest Period”) for current newsletter subscribers and new subscribers who enter online at trailappliances.com/contest.
By participating in the Contest, you acknowledge that you have read, understand and agree to be bound by these Trail Appliances E-newsletter Subscriber Contest Promotion Rules (these “Contest Rules”). If you do not agree to these Contest Rules, you may not participate in the Contest. Rules are also available online at trailappliances.com/contest.
ELIGIBILITY
The Contest is open to all residents of British Columbia who are at least 19 years of age as of the date of subscription. All directors, officers and employees of Trail Appliances and its subsidiaries and affiliates are ineligible to participate in the Contest.
HOW TO ENTER
No purchase is necessary to participate. To enter the Contest, you must be a Trail Appliances e-newsletter subscriber. New email newsletter subscribers can sign up online at trailappliances.com/contest, trailappliances.com/newsletter-lp or on the newsletter subscription pop-up on the trailappliances.com website during the Contest Period. Current e-newsletter subscribers are automatically entered.
Each newsletter subscriber is automatically granted one chance to participate (each, an “Entry”) in the Contest. Only one Entry per person. All Entries must comply with the requirements of these Contest Rules.
PRIZES
There is 1 prize available to be won:
One (1) KitchenAid Stand Mixer (#4KB25G1XMC) | valued at $450
The Prize is available to be won by all e-newsletter subscribers; in order to be eligible to win, you must already be a current subscriber or subscribe to the Trail Appliances newsletter during the Contest Period. No cash substitutions. Each Prize must be accepted as awarded and is non-transferrable. All other fees, charges or benefits, including delivery, assembly and installation charges and taxes, if required, are not included, unless otherwise stated and will be the responsibility of the winner. Trail Appliances reserves the right to substitute an alternate prize of equal or greater value should all or part of a Prize become unavailable for any reason. Use of the Prize are subject to any of the Prize applicable terms and conditions.
The odds of winning the Prize depend upon the number of eligible Entries.
HOW TO WIN
The winner of the Prize will be the first entrant whose name is selected at random from the eligible Entries and who comply with these Contest Rules.
A random draw from all eligible Entries will take place at 11am PST on November 19, 2020 in Richmond, British Columbia. Following the draw, Trail Appliances will notify the selected entrant by email as provided by the entrant (the “Notice”). The selected entrant must respond as directed in the Notice within three business days of the date on which the Notice was sent by Trail Appliances. If the selected entrant does not respond in accordance with these Contest Rules, or Trail Appliances is unable to contact the selected entrant for any reason, Trail Appliances may select another entrant from the remaining eligible Entries.
To win the applicable Prize, the selected entrant must correctly answer, without assistance of any kind, a time-limited, mathematical, skill-testing question. The answer will be verified and must be deemed to be correct.
Following successful completion of the skill-testing question, the selected entrant may claim their Prize by following the steps outlined in the prize letter. Prior to claiming the Prize, the selected entrant will be required to produce valid government issued photo identification and sign a declaration and release, in a form acceptable to Trail Appliances in its sole discretion, confirming that the selected entrant (a) has complied with these Contest Rules; (b) accepts the Prize as awarded; (c) releases Trail Appliances and its affiliates, subsidiaries, advertising and promotional agencies, representatives or agents, and their respective directors, officers, employees, agents and representatives (collectively, the “Trail Appliances Group”) from any and all liabilities in connection with the Contest and the Prize; (d) agrees to indemnify and save and hold harmless the Trail Appliances Group from any and all liabilities which the selected entrant or any other person may suffer or incur arising out of, related to, or connected with the Contest or the Prize; and (e) consents to the public announcement of the selected entrant’s name as the winner of the Prize and the use of the selected entrant’s name, address (city and province), photograph, image, statements regarding the Contest or the Prize, voice and other likeness, without remuneration, for advertising and promotional purposes worldwide.
Failure by a selected entrant to comply with these Contest Rules, as determined by Trail Appliances in its sole discretion, may result in a forfeiture of the selected entrant’s Prize.
OTHER MATTERS
Trail Appliances is not responsible or liable for: (a) erroneous, late, incomplete or misdirected Entries, regardless of the cause; (b) failure for any reason whatsoever of a selected entrant to receive a Notice; (c) computer, communication, or technical malfunctions or errors of any kind that may occur, regardless of the cause; (d) unauthorized human intervention in any part of the entry process or the Contest; (e) technical or human error which may occur in the administration of the Contest or the processing of entries; or (f) any damage, loss, harm, injury, cost or expense arising from, connected with, or relating to the Contest or the Prize, regardless of the cause or any fault by Trail Appliances or any person for whom they are responsible, and notwithstanding that any of those persons may have been advised of the possibility of the loss or damage being incurred.
You hereby release, remise and forever discharge the Trail Appliances Group from any and all claims, counterclaims, complaints, demands, causes of action, liabilities, and obligations of any nature or kind, whatsoever and howsoever arising, whether known or unknown, whether in law or in equity or pursuant to contract or statute in any way connected with, or which arise directly or indirectly from or relate to the Contest or the Prize.
Trail Appliances reserves the right to withdraw, cancel, terminate, modify or suspend all or any part of the Contest for any reason, including if Trail Appliances in its sole discretion determines that for any reason the Contest is not capable of being conducted as planned or intended by Trail Appliances or if any fraud, technical failures or any other factor beyond Trail Appliances’ reasonable control impairs the integrity or proper functioning of the Contest, by publishing a notice on www.trailappliances.com. Trail Appliances reserves the right in its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of the Contest or to be acting in violation of these Contest Rules or any other offer or in an unsportsmanlike or disruptive manner. Failure by Trail Appliances to enforce any term of these Contest Rules will not constitute a waiver of that provision.
WARNING: ANY ATTEMPT TO INTERFERE WITH THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND TRAIL APPLIANCES RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER RELIEF FROM ALL RESPONSIBLE PERSONS TO THE FULLEST EXTENT PERMITTED BY LAW.
Entries are void if, in Trail Appliances’ sole discretion, they are not legitimate newsletter subscribers, or if they are in whole or in part illegible, incomplete, damaged, irregular, altered, forged, reproduced, mutilated, counterfeit, tampered with, produced in error or obtained through fraud or theft. If for any reason an Entry is confirmed to have been erroneously lost or otherwise destroyed, your sole remedy is to submit another Entry during the Contest Period. No more than the stated number of Prize will be available. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of Prize as set forth in these Contest Rules to be available or claimed, Trail Appliances reserves the right to accept only the stated number of Prize.
These Contest Rules are governed solely by the laws of British Columbia, Canada and applicable federal laws of Canada, excluding any rules of private international law or the conflict of laws that would lead to the application of any other laws. Except where prohibited, any dispute between Trail Appliances and you or any other person arising from, connected with or relating to the Contest, participation in the Contest, the Prize, the use or misuse of personal information provided in connection with the Contest, or any related matters (collectively, “Disputes”) must be resolved before the Courts of British Columbia sitting in the City of Vancouver, British Columbia, Canada, and you hereby irrevocably submit and attorn to the original and exclusive jurisdiction of those courts in respect of all Disputes. Proceedings regarding a Dispute must be commenced within one year after the Dispute arose, after which time any and all proceedings regarding the Dispute are barred.
Decisions of Trail Appliances regarding any and all aspects of the Contest and the Prize are final and binding on all entrants.
PRIVACY
By entering the Contest, you consent to Trail Appliances’ collection, use and disclosure of your personal information for the administration of the Contest and for Trail Appliances to correspond with you, in its sole discretion, on promotions or offers in relation to your Entry in accordance with Trail Appliances’ Terms of Use and Privacy Policy.
